The Crisis: What Our Haitian Clients Are Facing
In June 2026, the U.S. Supreme Court ruled to allow the termination of Temporary Protected Status (TPS) for Haiti . This decision affects approximately 350,000 Haitian nationals who have built lives, careers, and families in the United States .
For years, these individuals have contributed to our communities—working in hospitals, schools, factories, and small businesses. They have paid taxes, raised children who are U.S. citizens, and become integral parts of their neighborhoods .
Now, they face detention and deportation to a country still recovering from devastating crises .
What we see in our office every day:
- Parents terrified they will be separated from their U.S.-born children .
- Workers who received letters from ICE ordering them to report for check-ins and ankle monitor fittings .
- Families scrambling to find any legal pathway—an asylum claim, a family petition, or a new route to permanent status .
How We Help
1. Identifying All Available Pathways
Temporary Protected Status may be ending, but it is not the only path. We work with each Haitian client to explore:
- Adjustment of Status: For those with family or employer sponsors, we help file petitions that can lead to green cards.
- Asylum & Withholding of Removal: For individuals who fear persecution if returned to Haiti, we build strong cases to protect them.
- The Haitian Refugee Immigration Fairness Act (HRIFA): A bill has been introduced in Congress (H.R. 9494) that would allow certain Haitian nationals to apply for permanent residency if they have been continuously present in the U.S. since June 2024 . We are monitoring this legislation closely and are prepared to act immediately if it passes.
2. Defense Against Deportation
When ICE comes knocking, we answer. We represent clients in removal proceedings, fight for bond, and file appeals to keep families together. Even for those with final removal orders, there may be options to reopen cases or request stays of removal .
3. Emergency Preparedness
We help families create emergency plans—identifying who will care for children if a parent is detained, gathering critical documents (like Alien Registration numbers), and ensuring they know their rights if stopped by law enforcement .
4. Fighting Fraud and Scams
In times of desperation, fraudulent “notarios” prey on vulnerable immigrants. We educate our clients on how to spot scams and direct them to legitimate, affordable legal services .
